Law as an existential problem? : the dialectics of law and existence in the South Korean queer politics

South Korean LGBTQ+ movement has increasingly used legislative and litigatory means since the late 2000s. Initially, the language of law was not always welcome, if not considered as a necessary evil, in the nation's LGBTQ+ communities and activism. However, various legal agendas and cases successfully established the institutionalization of human rights as a key element of activism in the past fifteen years. It attracts the most attention and political energy in Korea's LGBTQ+ movement. Activists and the interested public increasingly perceive the law as a primary tool for remedying social discrimination based on heterosexism and gender binarism. However, they still find tension between queering the status quo and institutionalizing queerness. This article explores how such tension is manifested in the LGBTQ+ movement from an anthropological perspective and examines the dialectics of 'law' and 'existence' in Korean queer politics while critically reviewing previous scholarship on the judicialization of politics.

한국 성소수자운동에서 법률 제개정 캠페인이나 소송 같은 사법절차 활용이 차지하는 비중은 2000년대 후반 이후 괄목할만한 성장을 보였다. 성소수자 커뮤니티와 활동가들에게 법의 언어가 처음부터 환영의 대상이었던 것은 아니었으며 법 영역에서의 싸움은 필요악으로 여겨지던 시기도 있었다. 그러나 구체적인 의제와 사건을 거치면서 현재 한국 성소수자운동에서 법을 중심으로 한 인권의 제도화는 가장 많은 주목을 받고, 많은 자원과 에너지가 집중되는 영역으로 자리잡았다. 이성애중심주의와 성별이분법을 근간으로 한 사회적 차별을 줄이는 주요한 도구로 법을 바라보는 관점이 점점 주류화되었지만, 그럼에도 불구하고 기존 체제를 퀴어화한다는 이상과 퀴어함을 제도화하려는 현실 사이에는 여전히 긴장이 존재한다. 이 논문은 정치의 사법화를 둘러싼 이론적 전개를 비판적으로 검토한 뒤, 제도를 퀴어화하고 퀴어함을 제도화하는 것 사이의 긴장이 성소수자운동의 일상에서 어떻게 드러나는지를 법인류학적 관점에서 살펴보고, 그 과정에서 어떻게 ‘법’과 ‘존재’ 사이에 변증법적 관계가 형성되는지를 밝힌다.
