Abstract
There are wide-ranging concerns about abuse and neglect of older persons in long-term care institutions (LTCIs) and associated human rights issues. These are magnified in relation to older lesbian, gay, bisexual, trans and queer (LGBTQ+) persons, many of whom fear discriminatory treatment in care spaces. While research is limited, there is evidence that some care staff, particularly those with strong religious beliefs, may hold negative attitudes. A recent UK documentary Ted and Noel about the abuse of a gay man with dementia, and the exclusion of his civil partner, offers rare insight into how such fears may be realised. This article considers its implications within UK regulatory contexts. It argues that problems in LTCIs will not be fully resolved by improved regulation, quality control, mandatory training or enhanced supervision, although these may help. Instead, as suggested in recent literature, what is needed are options which include de-institutionalised care in small group homes where personalised, safe care can be provided. While such settings may suit some older LGBTQ+ people, inclusive mixed settings are preferred by many. Regulatory reform must therefore be matched by structural change if the rights and wellbeing of older LGBTQ+ people in care are to be protected.
