Abstract
The aim of the chapter is to provide a concise presentation of the advantages and disadvantages of self-regulation and pre-market licensing as methods of controlling generative Artificial Intelligence in the People's Republic of China. These two methods are compared based on previous regulatory experiences in China from 2022 to 2024. The chapter is divided into three parts. The first part examines how the dual concept of the state in China influences the development and regulation of generative AI. The second part focuses on solutions that exemplify self-regulation within the sector of enterprises offering generative AI models in China, analysing service regulations, licenses, terms of service, and permissible use policies. The third part evaluates the effects of pre-market licensing for developers providing generative AI models services in China by the Cyberspace Administration of China. The chapter concludes with critical reflections on the potential applicability of China's regulatory experience to Poland and European Union, considering the different legal and economic contexts.
